The Ateneo de Manila University (AdMU) has clarified that head coach Tab Baldwin is contracted as a consultant rather than an employee under a consultancy agreement, addressing ongoing legal scrutiny from the Department of Labor and Employment (DOLE).

Lawyers representing AdMU's president argued that Baldwin's role involves discretion in coaching methods, distinguishing it from an employment contract where employers exert control.The dispute centers on whether Baldwin, a dual citizen of the U.S.and New Zealand, violated labor laws by working without an alien employment permit (AEP).

DOLE raised concerns about AdMU's management practices, including housing allowances and guidelines for Baldwin's activities, which the university claims are standard for independent contractors.Baldwin, who led Ateneo to four UAAP championships, faces immigration scrutiny despite having a resident alien status.The case gained attention after two student-athletes drowned during a training session, prompting DOLE to demand further documentation from AdMU.Legal experts emphasized that the key distinction lies in control over work methods, with Baldwin asserting his autonomy as a consultant.
