Federal Judge Orders Elon Musk to Testify in Lawsuit Over America PAC Voter Data Collection

A federal magistrate judge in Austin, Texas, has ordered Elon Musk to sit for a deposition as part of a fraud lawsuit involving his political action committee, America PAC.

The case was filed by two Arizona women, Jacqueline McAferty and Joy Harvick, who allege they were misled into providing their personal information after being encouraged to sign a petition supporting the First and Second Amendments.

According to the lawsuit, Musk promoted the petition during an October 2024 event in Pennsylvania by stating that America PAC would award $1 million each day to a randomly selected registered voter who signed it.However, the plaintiffs argue that the promotion was deceptive because the winners were allegedly not selected at random.

The complaint cites testimony from America PAC director Christopher Young, who reportedly acknowledged during a February deposition that the recipients had been deliberately chosen to serve as spokespersons for the organization rather than being randomly drawn.McAferty and Harvick contend they would not have submitted their personal information had they known how the selection process actually worked.The lawsuit seeks class-action status on behalf of more than one million individuals who signed the petition.Based on an estimated value of $47 per person's personal data, the potential financial exposure could exceed $47 million.In addition to ordering Musk's deposition, U.S.Magistrate Judge Susan Hightower directed him to produce unredacted internal documents that may be relevant to the case.

The litigation will examine whether America PAC's promotional campaign constituted fraud or deceptive practices related to the collection of voter data.
