First Nation secures jurisdiction over child welfare through landmark tripartite agreement

The Uashat mak Mani-utenam band council has officially taken control of its youth protection services, implementing a community-led legal framework under the Tshisheuatishitau Law.This historic agreement, signed with the federal and Quebec governments, marks a major milestone in Indigenous self-governance.

The $137 million federal funding pledge supports the transition of cases currently managed by Quebec’s youth protection authority to the community’s governance system.

Federal Indigenous Services Minister Mandy Gull-Masty and Quebec Social Services Minister Lionel Carmant emphasized the significance of the deal, which sets a precedent for First Nations in Quebec.

The agreement aligns with Bill C-92, which affirms Indigenous jurisdiction over child welfare, and follows a Supreme Court ruling that upheld the legislation.

This development paves the way for other First Nations communities to pursue similar arrangements, reflecting a shift in provincial and federal collaboration with Indigenous nations.
