EFCC's Asset Recovery Boosts Education in Nigeria
A resident of Ogun State, Adejare Olasunkanmi, has accused a police prosecutor, ASP Matthew Famuyiwa, of collecting a bribe and deliberately removing 18 important exhibits from a criminal case file, an action he said weakened the prosecution and eventually led to the acquittal of three defendants.
According to Olasunkanmi, the missing exhibits included crime scene photographs, medical reports, hospital records, receipts for treatment and medicine, recovered weapons, and bank statements which he claimed showed an attempted financial settlement by the accused persons.
He alleged that the prosecutor worked together with the defence counsel to frustrate the case after he refused offers to settle the matter out of court.
Olasunkanmi further stated that he had earlier petitioned the Assistant Inspector-General of Police in charge of Zone 2, alleging misconduct, criminal conspiracy and abuse of public trust by the prosecutor.
Although he said the petition was forwarded to the Ogun State Police Command for investigation, he claimed no meaningful investigation was carried out.
He therefore submitted another petition, asking the police authorities to investigate the alleged disappearance of the exhibits and prosecute anyone found responsible.
The report also referred to the judgment delivered by the Magistrate's Court in December 2024, where the court discharged and acquitted the defendants after holding that the prosecution failed to prove the offences beyond reasonable doubt.
The court specifically observed that photographs, medical reports and other documentary evidence supporting the assault allegations were not tendered during the trial.Olasunkanmi argued that these findings support his claim that the exhibits were removed before the case was concluded.
However, the allegations against the prosecutor remain claims by the complainant, and there is no indication in the report that the police officer has been found guilty of any wrongdoing or that an official investigation has confirmed the accusations.
