Johannesburg man sentenced to life imprisonment for murdering girlfriend after birthday assault
Dr Ganes Anil Ramdhin, a Cape Town gynaecologist, sought to reinstate his hospital admission privileges after being suspended by the Health Professions Council of South Africa (HPCSA) for professional misconduct.The Supreme Court of Appeal (SCA) ruled against him, stating that his medical contract automatically terminated upon suspension.The case traces back to 2019 when Ramdhin had an informal agreement with Rondebosch Medical Centre (RMC) to treat patients.However, his 2023 conviction for unprofessional conduct led to a three-year suspension, with one year active and two suspended under supervision.During his absence, RMC implemented strict new policies requiring peer reviews and active HPCSA status for admission.Despite Ramdhin's successful petition to resume supervised practice in 2024, RMC refused to reinstate his privileges, citing reputational risks.
The SCA rejected Ramdhin's argument that the suspension temporarily paused his contract, emphasizing that Section 44 of the Health Professions Act deems suspended practitioners' registrations 'cancelled.' The court concluded the 2019 agreement dissolved by law, leaving Ramdhin to navigate RMC's new credentialing processes.
