Lawyer Criticizes Supreme Court's Use of Purcell Principle in Election Cases
Supreme Court Justice Samuel Alito faces potential conflict of interest concerns after reports revealed that his son, Philip Alito, has been working as a political appointee attorney in the U.S.Treasury Department's office of the general counsel since the early months of President Donald Trump's second administration.
According to sources who spoke with NOTUS, Philip Alito has maintained a low profile, introducing himself simply as 'Phil' and avoiding drawing attention to his family name.He has no public resume or LinkedIn profile, and his name does not appear on the Treasury website.
As an attorney-adviser in the general counsel's front office, he was briefed on significant Treasury matters involving taxation, economic policy, and law enforcement. This role has raised questions due to ongoing high-stakes cases involving the Treasury Department that have reached or could reach the Supreme Court.
Notably, while Philip Alito was employed there, a lawsuit challenging Trump's use of emergency powers to issue tariffs named the Treasury as a defendant.Justice Alito did not recuse himself from the case and joined a dissent when the Court ruled against the administration in February.
The Treasury general counsel's office may also be involved in lawsuits related to Trump's anti-weaponization fund, which provides public money to individuals claiming unfair targeting by the Justice Department.Sources indicated that Philip Alito likely secured the position due to his family connections.Justice Alito's office did not respond to requests for comment.
The situation highlights ongoing debates about ethics, recusals, and family ties in high-level government positions, especially involving Supreme Court justices and executive branch agencies.
