Aidan Botha, a 49-year-old surfer from Cornwall, has launched a £500,000 legal claim against Away Resorts Ltd after sustaining a severe head injury while using a FlowRider wave simulator at the Retallack spa resort.The incident occurred in July 2022 when Botha collided with another rider, causing his skull to strike the pool floor.

The accident resulted in a hyperextension injury to his neck, leading to chronic burner syndrome characterized by burning pain, numbness, and tingling in his hands.This condition has significantly impaired his manual dexterity, affecting his ability to perform daily tasks and work.

Botha alleges that the resort failed to manage access to the wave machine, allowing multiple users to enter simultaneously, which contributed to the accident.While the resort admits breach of duty, it disputes the severity of the injuries and the compensation claimed.The case is set for a pre-trial hearing in London’s High Court, highlighting the complexity of the injuries and the legal battle over liability.
