Allahabad High Court Dismisses Jauhar University Petition Over Maintainability Concerns

The Allahabad High Court has dismissed a petition filed by a businessman on behalf of Mohammad Ali Jauhar University against the demolition of its buildings, citing maintainability issues.

The court observed that the petitioner, Mohammad Yusuf, is an outsider and not an official of the institution, which must be represented through its Registrar or officials.

Additional Advocate General Anupam Trivedi raised objections to the petition's maintainability, arguing that a stranger cannot act on behalf of the university.

Justice Saurabh Shyam Shamshery upheld this objection, stating that disposing of the petition would allow proceedings against the petitioner Trust/University to conclude logically.

Meanwhile, the Moradabad Divisional Commissioner's court granted an interim stay on the demolition of 38 buildings at the university, pending the final hearing.The demolition order was issued under Section 27 of the Uttar Pradesh Urban Planning and Development Act, 1973, with a deadline of July 30.Students and others have protested against the order, fearing loss of educational infrastructure.
