The Ateneo de Manila University is contesting the Department of Labor and Employment's (DOLE) claim that former men's basketball coach Tab Baldwin is an employee, asserting he is a consultant.

Lawyers for the university, including Krisha Santos and Philippe Quimbo, emphasized that Baldwin's agreement with Ateneo is a consultancy contract, granting him discretion over his work methods.

They argued that the university lacks control over Baldwin's coaching techniques, which is a key element distinguishing employment contracts from consultant agreements.

DOLE Secretary Francis Tolentino raised concerns about Baldwin's compensation, including housing and transportation allowances, suggesting an employee-employer relationship.

However, Baldwin's legal team, including lawyer Dong Feliciano, clarified that Baldwin secured a Philippine Quota Immigrant Visa for permanent residency instead of an alien employment permit, as the university advised.The dispute comes amid scrutiny over Baldwin's training methods following the deaths of two athletes during a team activity.The university maintains it does not control Baldwin's coaching methods, as he operates under a consultant arrangement.The case highlights legal and immigration complexities surrounding foreign professionals working in the Philippines.
