Ontario regulator reviews MAID practices following concerns over assessment location and clinical errors

A London, Ontario physician is facing increased scrutiny from the College of Physicians and Surgeons of Ontario (CPSO) following two separate complaints involving Medical Assistance in Dying (MAID) cases.

In one widely discussed case, a patient with inflammatory bowel disease and a history of mental health challenges was assessed for MAID outside a Tim Hortons café.

The doctor later drove the patient to the location where the procedure was carried out, raising concerns about professional boundaries and the appropriateness of conducting sensitive medical evaluations in public settings.

Regulatory reviewers noted that the assessment environment lacked the formality expected for end-of-life decision-making, and highlighted the absence of documented family input despite known concerns.In a second case, the same physician was involved in a MAID provision for a terminal cancer patient under a waiver of final consent.Complications arose when a key paralytic drug was not administered as intended.After the patient was initially pronounced dead, spontaneous breathing resumed once the doctor had left the residence.The physician returned, administered additional medication, and again declared death.The CPSO later found concerns about clinical judgment, documentation, and adherence to MAID protocols in several reviewed cases.

As part of disciplinary measures, the doctor agreed to at least six months of mandatory clinical supervision, chart reviews, and additional education on MAID procedures, consent, documentation, and professional conduct.

The regulator stated that while no criminal findings were made, the cases raised important questions about oversight, safety standards, and accountability in Canada’s MAID system, particularly regarding complex cases involving mental health history and end-of-life care protocols.
