Six Demonstrators Freed on Bail After Prosecution Drops Charges in Saba Saba Protests

Six demonstrators accused of blocking traffic during the July 7 Saba Saba protests have been released on bond after the prosecution declined to oppose their bail application.

The case, heard at Milimani Chief Magistrate's Court, saw defence lawyers argue that the charges criminalise the constitutional right to peaceful protest and waste judicial time.Principal Magistrate Paul Mutai granted each accused KSh 10,000 bond or KSh 2,000 cash bail, with the matter set for further mention.

The defendants, including Dickson Muli, James Bota, and Dennis Kimani, faced charges of obstructing motor vehicles along Harambee Avenue by allegedly barricading roads with stones.Defence counsel Babu Owino criticized the legal system for criminalizing protests, claiming citizens are arrested merely for exercising their rights. He also highlighted police misconduct, urging clearer identification of officers and accountability mechanisms. The prosecution maintained that constitutional issues raised by defence should be addressed in higher courts. One accused, Dickson Muli, claimed he was abducted during previous protests, appearing in court with injuries. The magistrate directed that any challenges to prior court orders must be filed at the originating court. This case underscores tensions between protest rights and law enforcement actions in Kenya.
