Supreme Court schedules hearing for lawyers challenging IHC social media case sentence
The Supreme Court of Pakistan has ruled in favor of overturning the convictions of two Muttahida Qaumi Movement (MQM) workers, Abdul Rehman alias Bhola and Zubair alias Chariya, in connection with the 2012 Baldia factory fire case.
The 39-page judgement emphasized that the prosecution failed to prove its case beyond reasonable doubt, highlighting the lack of conclusive evidence against the petitioners.
The court stressed that the state has a duty to protect human life, enforce safety obligations, and conduct impartial investigations to determine the real cause of tragedies.The original FIR accused factory owners of negligence, but the prosecution later shifted blame to the MQM workers, alleging extortion and arson.
However, the court found the revised case based on unreliable witnesses and hearsay, noting that key witnesses had initially been accused and later became prosecution witnesses, possibly to save themselves.The judgement also addressed the Muhajir community, cautioning against attributing guilt to an entire group without evidence.This ruling underscores the importance of due process and the state's responsibility to ensure justice, even in politically sensitive cases.
