The Supreme Court of the Philippines has clarified that it has not yet issued any ruling on the main petition filed by former President Rodrigo Roa Duterte and Senator Ronald “Bato” dela Rosa.
This clarification came amid public confusion following remarks attributed to Senior Associate Justice Marvic Leonen suggesting that a decision on the case was forthcoming.
The High Court emphasized that what will be released on Monday are the opinions related to the denial of a temporary restraining order (TRO) or status quo ante order in G.R.No.278747, not a decision on the main petition itself.
According to the Court’s spokesperson, the materials to be uploaded will cover the separate opinions regarding the petition filed by Duterte and Dela Rosa against former Executive Secretary Lucas Bersamin and other respondents.
The Supreme Court stressed that these documents pertain only to the TRO phase of the case and should not be interpreted as a final resolution of the main legal issues raised in the petition.
The confusion arose after Justice Leonen was quoted during a meeting with the Integrated Bar of the Philippines and Mindanao State University in Marawi City, where he reportedly mentioned that a decision would be released soon.
The Supreme Court later clarified that his statements were taken out of context and that the discussion primarily focused on Shari’ah law and the duties of lawyers, rather than the merits of the petition.
The High Court reiterated its commitment to proper judicial process and cautioned the public against misinterpretation of preliminary procedural developments as final rulings.As of now, the main petition remains pending and unresolved.
