Court Dismisses Nwoko’s Pre-Election Suit Over Legal Filing Issues

The Federal High Court in Abuja has dismissed Senator Ned Nwoko's lawsuit against former Delta State Governor Ifeanyi Okowa's APC senatorial ticket.Justice Mohammed Umar ruled the case was fundamentally defective and couldn't be fixed by amendment.

The suit, filed through attorney Dr Mike Nwoko, aimed to challenge Okowa's candidacy but failed because legal provisions clearly state only aspirants who participated in the party's primary can file pre-election cases.The judge emphasized that such rights are personal and cannot be transferred via power of attorney.

Defendants argued the case was incompetent from the start, and the court agreed, striking out both the amended summons and the substantive suit for lack of jurisdiction.

Sections 285(14) of the Constitution and 88(2) of the Electoral Act 2026 were cited to show the law doesn't permit representatives to file such cases.The ruling underscores that political party primary election challenges must be initiated directly by the affected aspirant, not through agents.
