The Katiba Institute has filed an urgent petition in court to challenge the Kenyan government’s proposed plans to establish Ebola quarantine facilities, including for Americans.

The petition, filed under a certificate of urgency by Counsel Joshua Malidzo, is directed against the Attorney-General and the Cabinet Secretary for Health.

It seeks four key court orders: to stop the establishment or approval of any Ebola or highly infectious disease facility in partnership with the US or other foreign governments; to prevent the entry of individuals exposed to Ebola; to compel the Health Ministry to present a detailed contingency plan within 24 hours showing Kenya’s preparedness for any potential Ebola outbreak; and to disclose full terms of any negotiations or arrangements with foreign governments.The move comes amid public concern over possible US collaboration on Ebola containment, despite Kenya not having reported any Ebola cases.

Katiba Institute emphasizes that the case is about constitutional accountability, public health protection, and ensuring that government actions do not endanger Kenyan citizens.

This follows reports that the US government had requested approval to establish a quarantine centre in Kenya, prompting strong public reactions and a Ministry of Health statement indicating potential cooperation with the US on virus containment measures.
